Trademark registration in China

Trademark registration in China is carried out through the Trademark Office of the State General Administration of Commerce and Industry of the People's Republic of China. The main law governing the registration and use of trademarks in China is the Trademark Law of the People's Republic of China.


The duration of trademark registration is up to 2 years. The validity of a trademark, as in Russia, is 10 years with the possibility of subsequent renewal.


An image consisting of words, graphics, letter and number combinations, three-dimensional objects, color combinations, as well as any combination of such images can be registered as a trademark. It is also possible to register audio trademarks.

Under Chinese law, a trademark owner is responsible for their products to their consumers and must guarantee their consumers the quality of their goods and services.



How is a trademark registered?

Step 1. Checking the trademark for protection
Verification is carried out according to the bases of the registering authority.
Step 2. Applying
In order to register a trademark in China, an application must be submitted to the registration authority. Citizens and organizations that are not residents of China are required to conduct all trademark registration activities through national patent attorneys.
Step 3. Trademark examination
Verification of the mark for compliance with the Chinese Trademark Law, including verification of uniqueness.

Step 4. Trademark publication

The publication is carried out in a special open bulletin. The bulletin with the published marks is posted on the department's website.
Step 5. Submission of objections to trademark registration
